H.R.5087 – Assault Weapons Ban of 2018

UPDATED March 31, 2018

The Supreme Court ruled in 2008 that the Second Amendment applies to individuals, not militias, and may include military weapons.  See details:  https://www.opdeepstate.com/2018/03/31/supreme-court-ruled-in-2008-that-second-amendment-applies-to-individuals-not-militias-and-may-include-military-weapons/

Although the Feds cannot confiscate your weapons under Federal Law, the sheriff in your county can allow the Feds to come into your county and take action against you.  Keep this in mind when you elect your sheriff.

Summary of HR 5087

Introduced in House (02/26/2018)

Assault Weapons Ban of 2018

This bill amends the federal criminal code to make it a crime to knowingly import, sell, manufacture, transfer, or possess a semiautomatic assault weapon (SAW) or large capacity ammunition feeding device (LCAFD).

The prohibition does not apply to a firearm that is: (1) manually operated by bolt, pump, lever, or slide action; (2) permanently inoperable; (3) an antique; or (4) a rifle or shotgun specifically identified by make and model.

Additionally, the bill does not prohibit, with respect to a SAW or LCAFD:

  • importation, sale, manufacture, transfer, or possession related to certain law enforcement efforts, or authorized tests or experiments;
  • importation, sale, transfer, or possession related to securing nuclear materials; and
  • possession by a retired law enforcement officer.

The bill permits continued possession, sale, or transfer of a grandfathered SAW, which must be securely stored. A licensed gun dealer must conduct a background check prior to the sale or transfer of a grandfathered SAW between private parties.

The bill permits continued possession of, but prohibits sale or transfer of, a grandfathered LCAFD.

Newly manufactured LCAFDs must display serial number identification. Newly manufactured SAWs and LCAFDs must display the date of manufacture.

The legislation amends the NICS Improvement Amendments Act of 2007 to require law enforcement agencies to be notified when a prohibited person attempts to purchase a grandfathered SAW.

It also amends the Omnibus Crime Control and Safe Streets Act of 1968 to allow a state or local government to use Edward Byrne Memorial Justice Assistance Grant Program funds to compensate individuals who surrender a SAW or LCAFD under a buy-back program.

This is a sample of letters people are sending to President Trump:

Mr. President, I urge you not to pass HR 5087. If you look at how Automatic Guns work, you have to pull the trigger every time you fire. This method also includes Handguns, ie: 45 Automatic, 9 MM Pistol and Some Shotguns. If this Bill passes, almost all guns will be banned. Even with Double Action Revolvers, you just pull the trigger every time you fire. I suggest everyone that has a firearm to be required to get a Hunter Safety Card before they can buy or own a gun. Realistically, you have to have a license to drive a vehicle and even build a house. How about we try this.

Thank you Sir for your time. John in Colorado

Dear Mr. Trump,

As a law abiding citizen who whole heartedly believes in the constitution, feel that it is my duty to voice my strong opposition against HR 5087. If passed I fear not only just the potential to cause massive civil unrest but thousands of new criminals that were once considered sportsmen only acting how the constitution permits. Mechanically speaking the bill in question has not only the potential to ruin shooting sports but also put a large number of American arms manufacturers out of business who our governemnt depends on at times of war. Mr. Trump I strongly urge you to respect our constitution and the American way of life vote by against not only HR 5087 but HR 3999 as well for being unconstitutional.

Thinking that this bill is so ridiculous that if passed will be impossible to enforce and will turn a lot of honest, law abiding citizens into criminals. Very few law enforcement members are going to face down a fellow citizen who is only exercising their 2nd amendment rights. There will be civil unrest I fear. This is all about power for the left and not even a a practical solution.
