Proposed bill would reward states that allow police to seize guns from potentially dangerous people

WASHINGTON, DC (WNEM) –

Four U.S. Representatives, including two from Michigan, introduced a bill that would provide grants to states that adopt laws that enable police officers to seize firearms from people they deem dangerous.

The bill, named the Jake Laird Act, was named after an Indianapolis police officer who was killed in 2004 by a man who struggled with mental illness, according to a press release by the U.S. Reps.

After Laird was killed, Indiana passed a law in 2005 that enabled officers to seize firearms with probable cause from individuals they determined to be a danger to themselves or others.

U.S. Reps. Debbie Dingell, Susan Brooks, Ted Deutch and Fred Upton introduced the bill on Wednesday.

It would provide grants to states that adopt similar laws to Indiana’s.

“We have a responsibility to come together – Democrats and Republicans – to keep our schools and communities safe,” Dingell said. “In the weeks since the horrific shooting in Parkland, Florida, I have met with law enforcement, prosecutors, mental health experts, the ACLU, students, teachers, parents, and other stakeholders to find common ground. One of the biggest takeaways from these conversations is that we need to provide family members and law enforcement the tools needed when they know someone is a threat to themselves or others. The Jake Laird Act builds on a successful Indiana law to help provide local law enforcement – who are on the frontlines of responding to these crises – with the resources necessary to act before warning signs escalate into tragedies, all while protecting due process.”

Upton said it will encourage states “to adopt common-sense ‘Red Flag’ laws.”

“We’ve been successful in getting bipartisan legislation passed to improve our background check system, increase funding for mental health, and billions for school safety programs. These efforts will make a real difference. The Jake Laird Act will be yet another tool in our law enforcement tool box. And my focus is on making sure they also have the proper training to make the proper decisions to prevent dangerous individuals from using firearms to harm themselves or others,” Upton said.

Now All Americans Will Be Microchipped On the Will Of Police : H.R.4919 Passed by House & Senate

Giving police the authority to decide who is micro-chipped and who is not based on their mental soundness is a recipe for disaster. Though the bill specifically mentions those with Alzheimer and autism, how long before these tracking programs are extended to those with ADHD and Bipolar disorder among other officially recognized disorders? Even the dislike of authority is considered a mental disorder known as “Oppositional Defiant Disorder.”

In reality the bill opens the door to give police the ability to microchip dissenters, and force cooperation on the part of the general population. In effect anyone who doesn’t go along with the mass conditioning will be labeled “mentally ill” and branded with a track-and-control chip. At the first sign of suspicious behavior, a troubling social media profile, or a misunderstanding during an encounter, police and medical personnel will have the authority to declare someone ‘mentally disabled’ (or incapacitated, or temporarily insane, or unsound of mind, or whatever label is handy) just because they express discontent, anger or outage at the state of the world and political affairs. “Fake news” journalists can be shut down, and “conspiracy minded” individuals controlled… and of course, it will be abused which will lead to a very nasty police state.

To Whom It May Concern:

I am writing you today in opposition of some troubling legislation you have introduced and/or are sponsoring: H.R. 5717- The Jake Laird Act of 2018, which would grant $50 million a year to states who adopt laws that authorize the seizure of firearms.

Congresswoman Susan Brook’s ‘One Page Summary’ says it requires both probable cause and due process, but I read it in its entirety. It is extremely vague, is rife with subjective terms, wreaks of ‘Guilty Until Proven Innocent’ and exudes tyranny. Guns would be seized first, which would leave the accused needing to hire an attorney and prove their ‘sanity’ to a court. The majority of people cannot afford this expensive, time-consuming process, nor should they be subjected to it.

The 4th Amendment of the United States Constitution guarantees our right “to be secure in our persons, houses, papers and effects, against unreasonable searches and seizures and ‘shall not be violated”. The 2nd Amendment guarantees our right to gun ownership and “shall not be infringed”; and the 5th and 14th Amendments guarantee our right to Due Process- BEFORE we are found guilty of a crime and have our possessions seized.

I do not trust this Bill, the United States Government, Police Officers, or our Courts to determine who is ‘mentally ill’ and who is not for a number of reasons, but to name a few: 1) “To authorize the Attorney General to make grants to States that have in place laws that authorize the seizure of firearms from dangerous individuals, and for other purposes.” -WHAT ‘other purposes’?! 2) “Probable Cause”. “Imminent Risk”, “Dangerous” and “Mentally Ill” are subjective. Our 2nd, 4th, 5th, and 14th Amendment Rights are not. 3) “(2) SEIZURE OF A FIREARM WITHOUT A WARRANT.– A law enforcement officer may seize a firearm from an individual who the law enforcement officer determines there is probably cause to believe is dangerous without obtaining a warrant under paragraph (1) in the case of exigent circumstances.”

In 2017, American police officers shot and killed 987 people. Some were justified, sure, but many involved unarmed victims- some with mental illness. Police Officers are not Health Professionals and not qualified to diagnose ‘Mental Illness’ on the spot. This task needs be left to a qualified, licensed Psychologist or Psychiatrist. Plus, that’s just not how our Constitutional Republic works. 4) Our courts are stacked with Liberal Extremist Activists, who use our courtrooms as a political platform. I certainly don’t trust them to determine anyone’s mental health condition. 5) There are already around 20,000 gun laws on the books, including those dealing with ‘mental illness’.

We don’t need anymore of your draconian gun laws. 6) Given that Left Wingers are traditionally opposed to gun ownership, I feel this is just another attack on the Right. 7) Among other innocuous individuals, the 2009 MIAC Report, which is distributed to Police Departments nationwide, listed ‘Christians, Veterans, Homeschoolers, Ron Paul Supporters and Pro Gun people as ‘potential domestic terrorists’.

This is downright disgusting. 8) Chicago has some of the country’s strictest gun laws, yet, in 2017, there were 2,785 shootings, with 650 of those ending in death. Obviously, the government is not able to keep guns out of the wrong hands as it is. How about you focus on the real problems for a change? 9) FEMA and the Department of Defense train American Police Officers that our Founding Fathers and their supporters are ‘terrorists’. The Southern Poverty Law Center has made the same claim, as well as several left wing media outlets. 10) I have noticed a disturbing increase in bias, censorship and propaganda- all directed at Right Wingers and gun owners in this country, be it on/in Social Media, the Mainstream Media, our Public Schools, or our own government. Take Debbie Wasserman Schultz’s latest charge that the “NRA is just shy of a terrorist organization.” We all know propaganda is a powerful tool. 11) Many politicians accept money from the anti-gun lobby, which skews the way they vote and encourages legislation just like this. I, for one, am tired of gun owners being bullied by the very people who swore to protect our rights. 12) Finally, if you were truly concerned about curbing ‘mental illness’, you would have cracked down on ANTIFA a long time ago! Of course, I could go on and on.

The point is- how CAN any of us trust you?! In closing, H.R. 5717 is dangerous.

Gun owners know the government wants their guns, and they know why. You all have been poking the bear for a long time. A(n) illegal ‘law’ such as this could potentially throw us into the next Civil War or Revolution. If it does, you all will have blood on your hands. I implore you to scrap this potentially harmful bill.
